Plaintiffs, Lucresia Mayorga Santamaria, et al., file this civil rights action on behalf of themselves or their members for declaratory and injunctive relief to enforce their rights under the Fourteenth Amendment of the United States Constitution and Title VI of the Civil Rights Act of 1964. Plaintiffs seek specifically to halt Defendants’ practice of segregating Plaintiff Latino children on the basis of their race, color or national origin at Preston Hollow Elementary School.

Because the Supreme Court established a new efficiency standard for facilities requiring Edgewood Appellees to show "similar need", the court should have remanded the case to the trial court for further proceedings on the issue.

Plaintiffs bring this class action against Quietflex Manufacturing Company, L.P., its general partner Quietflex Holding Company (collectively "Quietflex"), Goodman Manufacturing Company, L.P., d/b/a Quietflex Manufacturing Company, LP, and its general partner Goodman Holding Co. (collectively "Goodman") under federal laws prohibiting discrimination in employment on the basis of national origin.

Plaintiffs seek an order prohibiting Defendants from undertaking any action to conduct congressional and state senate elections under the congressional and state senate redistricting plans passed by the California Legislature in September 2001 and signed by the governor on September 27, 2001. Both of these plans deny the Latino community an equal opportunity to participate in the political process and to elect candidates of their choice. Plaintiffs also seek an order requiring Defendants to conduct elections in 2002 and election years after under the plan that Plaintiffs propose.

MALDEF opened its doors in San Antonio on August 1, 1968 and thus began it's struggle to promote and protect the legal right of Latinos in this Country . Some of the first cases to come to the attention of the lawyers dealt with school segregation, police brutality, and employment abuses.

Many years later, some of the many issues confronting Latinos sound all too familiar:

  • employment discrimination
  • education inequities
  • voting rights abuses
  • immigration concerns
The legal department staff accomplish their objectives through impact litigation, public policy, advocacy and community education. It chooses among these strategies based on the circumstances of the issue, past success or difficulty, staff resources and capabilities and financial resources. In other words, all goals will not be addressed simultaneously, but as needs and opportunities arise.

To better serve the changing needs of the Latino community, some of the litigation strategies have changed but the objectives of the organization remain the same. Until all Latinos are provided the opportunity to share equally in every facet of society, MALDEF's legal work will continue.
