Toolkit Anti-Immigrant Ordinance: MALDEF’s State and Local Anti-Immigrant Ordinance Toolkit
Obtaining comprehensive immigration reform is one of the most important legal issues facing the Latino community and at the top of MALDEF’s legal agenda. During the summer, as the U.S. House failed to move forward to complete legislative action, frustrations by anti-immigrant activists led to a small number of cities and town attempting to enact restrictions and prohibitions against illegal immigrants at the local level. MALDEF strongly opposes and will continue to fight local ordinances because they threaten to discriminate against all Latinos, citizen and newcomer alike. This guide describes the ordinances and their legal flaws, and provides arguments than can be utilized against them.

The Treatment of Undocumented Victims of Labor Law Violations Since Hoffman Plastics: Last year, the U.S. Supreme Court opened the door to abuse of undocumented workers in the case of Hoffman Plastics. The ruling states that federal immigration policy precludes the awarding of certain back pay remedies under the National Labor Relations Act (NLRA) to undocumented workers.
This report was prepared by MALDEF and the National Employment Law Project on reported cases that have attempted to curtail labor and employment rights of undocumented workers after the Hoffman Plastics decision.

Chicago Progress Report: An Evaluation of the Chicago Public Schools’ Efforts to Relieve Student Overcrowding At Elementary Schools.
To address the poor and inadequate condition of school buildings across the city, the Chicago Public Schools (CPS) established a Capital Improvement Program (CIP) in 1996. The CIP is an ongoing plan for reviewing and upgrading CPS’ infrastructure over a five-year period based on an assessment of building needs and overcrowding. One of the main goals of the CIP is to reduce student overcrowding to no more than 80 percent of each school building’s design capacity. To fulfill this goal, the CIP has a construction program that consists of capital projects that will provide overcrowding relief to schools. The capital projects include additions, annexes, new replacement schools, and new area schools.

Latinos comprise a significant share of these families that are working, but poor. Two legislative proposals seek to create a state Earned Income Tax Credit (EITC), a tax mechanism with the potential to substantially affect the Latino community.
