On April 23, 2019, MALDEF (Mexican American Legal Defense and Educational Fund) filed a lawsuit, on behalf of an individual job applicant work-authorized through DACA (Deferred Action for Childhood Arrivals), which alleged that the plaintiff was denied an employment position at VMware because she is a DACA holder. The action was filed as a potential class action and as a PAGA representative action on behalf of other work-authorized recipients who may have been denied employment at VMware. VMware denied the allegations made by MALDEF and, in fact, welcomes employment applications from anyone who has work authorization, including DACA holders. Following productive discussions, this litigation was resolved to the satisfaction of both parties.
